Silvertung SMS Verbal Consent

Last Updated: October 5, 2026

This page documents how verbal consent to receive text messages is obtained before any mobile number is enrolled in the Silvertung text messaging program. It is published so that recipients, carriers, and messaging reviewers can see the exact disclosure clients hear and the procedure staff must follow. Enrollment is verbal only; there is no web sign-up form for this program.

1. Program Description

The text messaging program sends transactional messages only, and is limited to two message types:

  • A secure link to a page where the client can upload documents related to their matter.
  • A one-time verification code confirming the client's identity before that page can be opened.

Messages are sent only in connection with an active matter and only after the client has verbally agreed to receive them. This program does not send marketing, advertising, or promotional messages of any kind.

2. How Consent Is Obtained

Consent is obtained verbally, by phone, during a conversation between the client and staff. Staff read the script in Section 3 in full and ask the client to agree before the mobile number is enrolled. No other opt-in method is used for this program: there is no web enrollment form, keyword text, or QR code.

3. Verbal Consent Script

Staff read the following script in its entirety. It is reproduced here exactly as staff read it.

“May Silvertung send text messages to this mobile number containing secure document-upload links and verification codes? Message frequency varies by request, typically an upload-link message and a verification-code message per request. Message and data rates may apply. Reply STOP to opt out or HELP for assistance. Text messaging is optional, and declining will not affect your legal representation. You can review our SMS Terms at www.silvertung.io/sms-terms and our SMS Privacy Policy at www.silvertung.io/sms-privacy. Do you agree to receive these text messages?”

Script version 1.0 — effective October 5, 2026. The policies the script refers to are linked in Section 6 below.

4. Staff Procedure

Staff must follow this procedure for every number enrolled in the program:

  1. Read the complete script above before enrolling the client or sending the first SMS.
  2. Obtain an explicit affirmative answer. Providing a phone number alone does not establish consent.
  3. Document the client’s answer, the date and time, the mobile number, the staff member who read the script, and the script version in the client’s file.
  4. Enroll the number only after the client agrees.
  5. If the client declines, arrange another method of communication.
  6. Honor opt-out requests and follow the configured messaging system’s procedures.

5. Opting Out and Getting Help

As stated in the script, clients are told they may reply STOP to opt out of further text messages or HELP for assistance. Clients may also opt out, or ask for help, verbally or in writing by contacting us directly. Staff honor opt-out requests and follow the procedures configured in the messaging system. Opting out does not affect a client's legal representation, and the firm can continue to reach the client by phone, email, or mail.

6. Related Policies

7. Questions

We collect consent and enroll numbers for this program, so questions about a specific number, a consent record, or an opt-out request should be directed to us directly using the contact information the firm provided for your matter.
